GENERAL TERMS & CONDITIONS

1. Scope of Application

These Terms & Conditions govern all bookings, stays, and services
provided by the Hotel. By confirming a booking, the Guest/Client agrees to be
legally bound by these Terms.

The contractual relationship consists of:

  • The booking confirmation, and
  • These Terms & Conditions


In case of conflict, the booking confirmation shall prevail.

 

2. Definitions

  • Hotel: Fiftyfour West Boutique Living, Għarb, Gozo
  • Guest: Any person staying at the Hotel
  • Client: The person making the booking (may be the Guest or third party)
  • Booking: Any reservation made with the Hotel
  • Group Booking: Reservation of 3 or more rooms
 
3. Conclusion of Contract

A contract is formed once a booking confirmation is issued.

The Client:

  • Accepts full responsibility for all guests under the booking
  • Warrants authority when booking on behalf of others
  • Is jointly liable with all guests for obligations arising from the booking
 
The Hotel reserves the right to refuse any booking at its discretion.

 

4. Rates, Payment & Taxes

  • Rates are subject to change until booking is confirmed.
  • Confirmed rates are binding.
 
Payment Conditions:
  • Payment terms depend on the booking type and channel.
  • The Hotel reserves the right to:
    • Pre-authorize credit cards
    • Charge deposits or full payment prior to arrival
 

Booking Types:

  • Non-refundable bookings:
    • Fully prepaid
    • Non-cancellable and non-modifiable
  • Flexible bookings:
    • Subject to cancellation conditions communicated at booking
 

Additional Charges:

  • The eco/contribution tax is payable on arrival
  • The Hotel reserves the right to charge for:
    • Additional services
    • Incidentals
    • Damages


Failure to provide valid payment may result in cancellation without notice.

 

5. Group Bookings

Bookings of 3 or more rooms are subject to:

  • Separate quotation and approval
  • Custom payment and cancellation terms


The Hotel may:

  • Request deposits
  • Set stricter cancellation policies
  • Adjust pricing based on final room allocation


The Client must:

  • Provide final rooming list prior to arrival
  • Ensure all guests comply with these Terms
 
 

6. Check-in & Check-out

  • Check-in: from 15:00
  • Check-out: by 11:00
 

The Hotel is not obliged to provide early check-in or late check-out. Late
check-out may incur additional charges, including:

  • Up to 50% of nightly rate
  • Up to 100% if significantly exceeded
 
 

7. Children Policy

  • Children under 12 stay free using existing bedding
  • Guests aged 13+ are charged as adults
  • Rollaway beds are always chargeable
 

Parents/guardians are fully responsible for minors at all times.

 

 

8. Pets Policy

Pets are permitted under the following conditions:

  • One-time fee of €25 per stay
  • Pets must be supervised and well-behaved

The Hotel reserves the right to:

  • Remove guests if pets cause disturbance or damage
  • Charge for any damages or additional cleaning
 
 

9. Use of Facilities

Guests may use hotel facilities subject to availability and compliance with rules.

Pool Rules:

  • No diving
  • No running
  • No ball games
  • Children must be supervised at all times
 

 Important:

  • No
    lifeguard is present
  • Use
    of pools is entirely at Guest’s own risk
 

The Hotel shall not be liable for:

  • Accidents
  • Injuries
  • Misuse of facilities
  •  

The Hotel reserves the right to restrict or close facilities at any time without compensation.

 

 

10. Smoking Policy

Smoking is strictly prohibited indoors. Smoking is allowed only in designated outdoor areas.

Violation may result in:

  • Cleaning fees
  • Damage compensation
  • Termination of stay
 
 

11. Guest Conduct & Hotel Rights

Guests must:

  • Respect other guests and staff
  • Follow all hotel rules
 

The Hotel reserves the right to:

  • Refuse entry
  • Terminate a stay immediately
 

In cases of:

  • Misconduct
  • Disturbance
  • Illegal activity
  • Damage to property

No refund shall be given in such cases.

12. Damages & Security

Guests are liable for any:

  • Damage to rooms or property
  • Loss caused by negligence or misuse
 

The Hotel may:

  • Request a valid credit card as guarantee
  • Charge the card for damages without prior notice where necessary
 
 

13. Cancellation Policy

General Rule:

Cancellation terms depend on booking type.

Non-refundable:

  • 100% charge at booking
  • No refunds or changes
 

Flexible:

  • Cancellation terms as communicated at booking
  • Late cancellations or no-shows may incur charges
 

Group Bookings:

  • Subject to stricter cancellation terms
  • May be charged in full depending on timing
 
 

14. Liability of the Hotel

The Hotel shall only be liable in cases of:

  • Gross negligence
  • Intentional misconduct
 

The Hotel is not liable for:

  • Loss or theft of personal belongings
  • Injury or damage caused by misuse of facilities
  • Events beyond its control (force majeure)
 

Guests are responsible for safeguarding their belongings.

 

15. Force Majeure

The Hotel shall not be liable for failure to perform obligations due to events beyond its control, including but not limited to:

  • Natural disasters
  • Government restrictions
  • Utility failures
  • Or any other force majeure that is beyond the Hotel’s control.

 
 

16. Data Protection (GDPR)

All personal data is processed in accordance with Maltese data protection laws and used solely for operational and legal purposes.

 

17. Governing Law & Jurisdiction

These Terms are governed by the laws of Malta. Any disputes shall be subject to the exclusive jurisdiction of the Maltese courts.

 

18. Final Provisions

  • These Terms constitute the entire agreement between parties
  • No verbal agreements shall be binding
  • The Hotel reserves the right to amend these Terms at any time
